PREAMBLE: Trade policy

These General Conditions of Sale govern the sale of BAPTISTE CAVALLI articles on the site www.baptiste-cavalli.com by the company BAPTISTE CAVALLI, micro-enterprises, registered with the Chamber of Trades and Crafts of Bourgogne-Franche -Count under the number SIRET 84284508300018, whose head office is located at 3 rue de l'horizon - 25500 Le Bélieu - France.

The General Conditions of Sale constitute the only agreement between the parties and prevail over any other document. They can be changed at any time. The new General Conditions of Sale will be applicable to any order subsequent to their being made available on the site.

The company BAPTISTE CAVALLI sells on the site www.baptiste-cavalli.com products intended exclusively for end users called consumers. The consumer does not operate for professional or business purposes.

The resale of BAPTISTE CAVALLI items is strictly prohibited.

Under these conditions, BAPTISTE CAVALLI reserves the right not to follow up on orders from subjects other than consumers or orders not in accordance with its commercial policy.

ARTICLE 1: Items available for sale on the website

The items offered for sale on the site www.baptiste-cavalli.com are of first quality, made in France.

The characteristics of each item are described in each product section.

The colors and photos of the articles may nevertheless differ from reality, simply due to the variations of the computer screen.

The articles are made 100% handmade and, as such, may present irregularities related to artisanal manufacturing and "natural" raw materials.

The offers of the articles are understood within the limits of available stocks. Information on the availability of items is provided in the product section and / or when the order is placed.

An item with an "*" indicates a limited edition that cannot be remanufactured.

In the event that one of the items or a material is not available in our stocks, we undertake to contact you by email within a maximum period of 15 days from the date of your order, in order to inform you and tell you when the order could be delivered to you. You will have the possibility of maintaining your order or of canceling it. The cancellation will give rise to a refund according to the conditions mentioned in article 7.

 

ARTICLE 2: Unit prices of items and the total amount of the order

Item prices are inclusive of all taxes (20% as of January 1, 2015), excluding transport costs. They are indicated in Euros.

Prices are subject to change at any time, it being understood that the items are invoiced on the basis in force when the order is recorded. Any change in the applicable statutory VAT rate will automatically be reflected in the prices of the items, as soon as it comes into force.

The total amount of the order is indicated on the "Basket" page and indicates in particular the following information:

In the case of sales outside France, you are then the importer. For any product shipped outside the European Union, the price will be calculated automatically on the invoice. Customs duties, local taxes, import duties or state taxes may be required. All are your responsibility and are your responsibility both in terms of declaration and payment to the competent authorities and bodies of the importing country.

The selling prices differ depending on the geographical areas.

A: Orders are delivered on a DDP basis (Delivered Duty Paid) in the following countries:

B: If your country is not on the above list (A), you, as the importer, are liable for the freight charges, payment of all import taxes, customs duties and taxes. local sales requirements imposed by the country in which you receive the products. Payment of these taxes is necessary so that your order can be cleared through customs.

 

ARTICLE 3: The order

Order taking is subject to compliance with a procedure, the main phases of which are as follows:

Confirmation of the order :

- "Modify basket" button, if you wish to modify the basket

- Entering your contact details (email, first name, last name, address, city, country, region, postal code, telephone)

- Selection of delivery method

- Confirmation of payment and entry of banking information

- Billing address: check the same as the delivery address or enter another address.

 

Order confirmation :

- Viewing the secure payment page of our partner Stripe

- Confirmation of payment and entry of banking information

- Receipt of a printable order confirmation electronic message in lieu of an order form, containing the contact details of our E-commerce Customer Service and information relating to the right of withdrawal

- The invoice will be sent by email or attached to the package when the order is shipped.

- Receipt of a shipment confirmation email with the shipment number noted on the package, when the order is shipped (this email message cannot be answered)

An order placed on a Saturday, Sunday or public holiday will not be processed and validated until the next working day.

 

ARTICLE 4: Payment

 

For the payment of item prices and shipping costs, you can follow the terms in your order form.

Payment for your purchases is made exclusively by credit card when placing your order (credit card, Visa, Eurocard / MasterCard, PayPal, AMERICAN EXPRESS, Apple pay).

BAPTISTE CAVALLI may ask to receive a copy of the identity card in order to verify that it is not a stolen payment card.

In case of payment by means of a credit / debit card, the financial information (for example the number of the credit / debit card or the due date) will be transferred by SSL encrypted protocol to our partner STRIPE without any third parties cannot access it under any circumstances. Such information will never be used by BAPTISTE CAVALLI, other than to complete the procedures related to your purchase or to issue refunds in the event of any return of the products following the right of withdrawal or if it is necessary to prevent or report to competent authorities the occurrence of fraud on the site www.baptiste-cavalli.com.

Payment card numbers are not stored on our computer systems.

If your debit / credit card is not in euros, the final price is calculated in accordance with the exchange rate applicable on the day your card issuer processes the transaction.

We remain owners of the items sold until full payment of the price, VAT and shipping costs included.

 

ARTICLE 5: Delivery

 

5.1 Destination:

The items offered for sale by BAPTISTE CAVALLI are delivered according to the following breakdown:

- European Union

- United States of America

- Japan

- Rest of the world

The items will be delivered to the delivery address indicated during the ordering process.

BAPTISTE CAVALLI cannot be held responsible if the delivery address indicated is incorrect or non-existent.

Items that have not been collected at the delivery point within the time period indicated (14 days) will be returned to BAPTISTE CAVALLI. You will then be debited for an amount corresponding to the costs incurred by this return.

5.2 Deadlines:

​

- 10 working days for items available in stock

Please note that these times may fluctuate depending on the product, the carrier.

Deliveries are made by LA POSTE for France and the European Union, and by DHL for Japan, the United States of America and the rest of the world.

We will ask you to contact us in the event that we will not be able to deliver all the items of the same order at the same time.

5.3 Transport costs:

​

Shipping costs are calculated automatically as soon as you finalize your shopping cart and appear in the total payable during the ordering process.

Metropolitan France: shipping costs for metropolitan France offered for all orders over 50 euros. Colissimo delivery method. Delivery time 48 hours (indicative time in working days).

The packages will be delivered against signature of the recipient.

In the event of loss or theft, you, as the recipient customer, must inform the carrier without delay.

5.4 Delivery issues:

​

Any defect or delay in delivery exceeding eight (8) working days must be reported to our E-commerce Customer Service as soon as possible. Any complaint formulated beyond thirty (30) calendar days after the date of validation of your order cannot be taken into account.

You must check the conformity of the goods at the time of delivery and indicate, on the delivery note in the form of handwritten reservations accompanied by your signature, any anomalies noted (open package, damaged product, etc.).

ARTICLE 6: Return and right of withdrawal

You have a period of thirty (30) days from the day of receipt of the items purchased on the site www.baptiste-cavalli.com to exercise your right of withdrawal, without any penalty and without specifying the reason, within conditions provided for in Article L. 121-20 et seq. of the Consumer Code.

To do this, simply send our E-commerce Customer Service by email: contact@baptiste-cavalli.com your decision, unambiguously formulated and before the expiry of the withdrawal period, using for example the model withdrawal below:

After validation by the E-commerce Customer Service, you will receive by email the Return Voucher bearing the return authorization number to print (or download and print) and must be included with your package, as well as the address return.

You must then return the item (s) to us to the following address: BAPTISTE CAVALLI, 3 RUE DE L'HORIZON 25500 LE BELIEU, FRANCE.

The right of return will be acquired under the conditions where the item will be returned new and in its original packaging. The label will still be attached to the product. The product will not have been worn, worn, modified or damaged and in perfect condition to be put on sale again.

In the event of an error attributable to BAPTISTE CAVALLI (defective item or order preparation error), BAPTISTE CAVALLI will bear the cost of returning the item. You must proceed with the return request in accordance with the process described above, then follow the instructions given to you and finally deliver the package to the carrier which will be indicated to you by BAPTISTE CAVALLI.

 

- Personalized collection items:

Given the unique and personalized nature of the made-to-measure article, it cannot be returned or exchanged, in accordance with article L.121-20-2 of the Consumer Code ("The right of withdrawal may not be exercised, unless the parties have agreed otherwise, for contracts: […] 3 ° Supply of goods made to the consumer's specifications or clearly personalized or which, due to their nature, cannot be returned or are liable to deteriorate or expire quickly ”).

As a result, you have no option to invoke a right of withdrawal.

Also, we recommend that you devote the necessary time and attention to creating your article.

 

ARTICLE 7: Refund

Upon receipt of your return package, and to the extent that all the conditions mentioned above have been met, BAPTISTE CAVALLI will inform you by email that it will proceed with the refund, by crediting the bank account that was used for payment. of the order, as soon as possible and at the latest within 14 days of the date on which you have exercised your right (article L. 121-20-1 of the Consumer Code).

In the case of the delivery of an order outside France, BAPTISTE CAVALLI will reimburse the price of the items, except for customs duties or any costs which will have been charged to you upon importation.

 

ARTICLE 8: After-sales service, liability

​

The BAPTISTE CAVALLI after-sales service is responsible for repairing wear and tear on your items.

To contact our after-sales service, we invite you to contact us preferably by email: contact@baptiste-cavalli.com giving as much detail as possible on the condition of the item and information on the purchase ( reference, name of the model, number and date of the order), also specifying the area to be repaired, attaching if possible photos of the entire item and of the area to be repaired.

Your article will be forwarded to our workshops who will take the appropriate decision:

- In the event of a manufacturing defect noted and validated by our workshops, we will repair your item free of charge or replace it with a new item of equivalent value.

- For used items, the repair will be chargeable. However, you will be offered an estimate and the repair will only be carried out after your acceptance of the estimate.

- Your item will not be repaired if it is too worn. It will then be returned to you as is.

 

ARTICLE 9: Legal guarantee of conformity and hidden defects

 

BAPTISTE CAVALLI articles benefit from the legal guarantee of conformity as well as the guarantee against hidden defects, in accordance with the provisions in force (articles L. 211-1 to L. 212-1 of the Consumer Code, articles 1641 and 1648 of the Code. Civil).

You have a period of two (2) years to invoke said guarantees from Customer Service. This period starts from the delivery of the articles for the legal obligation of conformity (article L. 211-12 of the Consumer Code) and from the discovery of the defect for the guarantee of hidden defects (article 1648 of the Civil Code).

 

ARTICLE 10: Liability

 

BAPTISTE CAVALLI is not responsible for possible “computer screen / reality” color difference.

Furthermore, BAPTISTE CAVALLI will not be considered responsible or at fault for any delay or non-performance resulting from the occurrence of a case of force majeure.

 

ARTICLE 11: Information technology and freedoms

 

Your personal data are necessary to process your order and are not at any time intended to be sold, marketed or rented to third parties.

 

ARTICLE 12: Intellectual property

The intellectual property rights on the site www.baptiste-cavalli.com and on all the elements that compose it (brands, models, images, graphics, copyright, domain names, etc.) are subject to '' a right of ownership or exclusive use for the benefit of BAPTISTE CAVALLI. Any total or partial reproduction of the site is strictly prohibited.

 

ARTICLE 13: Applicable law and disputes

These General Conditions of Sale, the order and all acts resulting from them are governed by French law. In the event of a dispute and in the absence of an amicable settlement, the French courts have sole jurisdiction.
